Notice of Intended Action
Twenty-five interested persons, a governmental subdivision, an agency or association of 25 or more persons may demand an oral presentation hereon as provided in Iowa Code section 17A.4(1)"b."
Notice is also given to the public that the Administrative Rules Review Committee may, on its own motion or on written request by any individual or group, review this proposed action under section 17A.8(6) at a regular or special meeting where the public or interested persons may be heard.
Pursuant to the authority of Iowa Code section 135.181, the Department of Public Health hereby gives Notice of Intended Action to amend Chapter 107, "Board-Certified Behavior Analyst and Board-Certified Assistant Behavior Analyst (BCBA/BCaBA) Grants Program," Iowa Administrative Code.
Chapter 107 was recently established to implement the board-certified behavior analyst and board-certified assistant behavior analyst grants program. The proposed amendment corrects language that limited the awarding of the grant due to an inflexible limit on contract length. The proposed amendment will positively impact the execution of the program. Regarding contracts, the Department will continue to follow the requirements for competitive selection contained in 641—Chapter 176 in awarding the program grant funds.

After analysis and review of this rule making, it is projected that this amendment will positively impact board-certified behavior analyst and board-certified assistant behavior analyst employment opportunities in Iowa.
This amendment is intended to implement Iowa Code section 135.181.
The following amendment is proposed.
Amend subrule 107.7(1) as follows:
107.7(1) An applicant shall complete and submit an application to the program in the manner specified by the department. An applicant, if awarded a grant, shall enter into a contract with the department for up to a four-year period. The department shall follow requirements for competitive selection contained in 641—Chapter 176 in awarding these funds.
