The Director of the Workforce Development Department hereby amends Chapter 23, “Employer’s Contribution and Charges,” Iowa Administrative Code.

Purpose and Summary
The purpose of this subrule is to provide guidance on submitting an employer liability appeal pursuant to Iowa Code chapter 96.

Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on January 7, 2026, as ARC 9940C. Public hearings were held on the following date:

Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any.

Effective Date
This rulemaking will become effective on April 8, 2026.
The following rulemaking action is adopted:
ITEM 1. Rescind subrule 23.52(3) and adopt the following new subrule in lieu thereof:
23.52(3) The appeal shall be addressed or delivered to: Department of Workforce Development, Tax Bureau, 1000 East Grand Avenue, Des Moines, Iowa 50319. Appeals that are received by the tax bureau after 11:59 p.m. central time will be deemed filed as of the next regular business day.
