Notice of Intended Action

Proposing rulemaking related to child care homes
and providing an opportunity for public comment

    The Department of Health and Human Services hereby proposes to rescind Chapter 120, “Child Care Homes,” Iowa Administrative Code.

Legal Authority for Rulemaking

    This rulemaking is proposed under the authority provided in Iowa Code section 237A.12.

State or Federal Law Implemented

    This rulemaking implements, in whole or in part, Iowa Code section 237A.12.

Purpose and Summary

    This chapter establishes procedures for child care homes that have a child care assistance provider agreement to receive child care assistance funds. Pursuant to Executive Order 10, this chapter underwent a Red Tape Review. During that analysis, it was determined that the content of Chapter 120 could be combined into a new 441—Chapter 110 (ARC 0540D, IAB 9/2/26) because there are many similarities between registered child development homes and child care homes with a child care provider agreement. As such, Chapter 120 is proposed to be rescinded.

Fiscal Impact

     This rulemaking has no fiscal impact to the State of Iowa.

    After analysis and review of this rulemaking, no impact on jobs has been found.

Waivers

    Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 441—Chapter 2504.
