CORRECTIONS DEPARTMENT[201]

Notice of Intended Action

Proposing rulemaking related to departmental organization and procedures
and providing an opportunity for public comment

The Department of Corrections hereby proposes to rescind Chapter 1, “Departmental Organization and Procedures,” Iowa Administrative Code, and to adopt a new Chapter 1 with the same title.

Legal Authority for Rulemaking

This rulemaking is proposed under the authority provided in Iowa Code section 904.103.

State or Federal Law Implemented

This rulemaking implements, in whole or in part, Iowa Code chapter 904.

Purpose and Summary

This proposed rulemaking rescinds and replaces Chapter 1 with revised administrative rules to satisfy the requirements of Executive Order 10. The purpose of Chapter 1 is to provide the public with a clear, accessible overview of the Department’s organizational structure, mission, and central contact protocols.

Pursuant to Executive Order 10, the Department conducted a comprehensive review of this chapter to eliminate restrictive terms, obsolete rules, and language that duplicates State statutes. Specifically, this rulemaking does the following:

?   Updates the description of the Board of Corrections to align its function with the statutory changes mandated by 2024 Iowa Acts, Senate File 2385.

?   Consolidates and streamlines public contact paths.

?   Deletes granular internal staff responsibilities and specific facility contact metrics that are more accurately maintained on the Department’s active website, thereby preventing the rules from becoming instantly obsolete.

?   Eliminates redundant text regarding topics that are already comprehensively governed by Iowa Code chapters 21 and 904.

The result is a streamlined chapter that maintains essential public transparency while ensuring alignment with provisions of the Iowa Code.

Regulatory Analysis

A Regulatory Analysis for this rulemaking was published in the Iowa Administrative Bulletin on August 19, 2026. A public hearing was held on the following date(s):

     ?   September 8, 2026

No comments were received, and no changes from the Regulatory Analysis have been made.

Fiscal Impact

This rulemaking has no fiscal impact to the State of Iowa.

Jobs Impact

After analysis and review of this rulemaking, no impact on jobs has been found.

Waivers

Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 201—Chapter 2504.

Any interested person may submit written or oral comments concerning this proposed rulemaking, which must be received by the Department no later than 4:30 p.m. on November 3, 2026. Comments should be directed to:
