HUMAN SERVICES DEPARTMENT[441]
Notice of Intended Action
Proposing rulemaking related to rent reimbursement
and providing an opportunity for public comment
The Department of Health and Human Services hereby proposes to amend Chapter 62, “Rent Reimbursement,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is proposed under the authority provided in Iowa Code section 425.37.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, Iowa Code chapter 425 and 2026 Iowa Acts, Senate File 2472.
Purpose and Summary
This proposed rulemaking eliminates outdated language and codifies the Department’s practice that electronic applications received after 4:30 p.m. will be counted as having been received on the next business day. In addition, this proposed rulemaking implements 2026 Iowa Acts, Senate File 2472, division VII, by reflecting the increase in the maximum reimbursement amount from $1,000 to $1,500 beginning with claims for reimbursement for property tax paid during 2026.
Regulatory Analysis
A Regulatory Analysis for this rulemaking was published in the Iowa Administrative Bulletin on September 2, 2026. A public hearing was held on the following date(s):
? September 23, 2026
Fiscal Impact
This proposed rulemaking has no impact on State revenues beyond Item 2, which implements 2026 Iowa Acts, Senate File 2472, division VII. This increases the maximum amount of rent reimbursement a claimant can receive from $1,000 to $1,500. The Legislative Services Agency estimates an approximate $300,000 increase in the amount appropriated beginning in State fiscal year 2027.
Jobs Impact
After analysis and review of this rulemaking, no impact on jobs has been found.
Waivers
Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 441—Chapter 2504.
Public Comment
Any interested person may submit written or oral comments concerning this proposed rulemaking, which must be received by the Department no later than 4:30 p.m. on November 3, 2026. Comments should be directed to:
Victoria L. Daniels |
Public Hearing
A public hearing at which persons may present their views orally or in writing will be held as follows:
November 3, 2026 | Microsoft Teams |
Persons who wish to make oral comments at the public hearing may be asked to state their names for the record and to confine their remarks to the subject of this proposed rulemaking.
Any persons who intend to attend the public hearing and have special requirements, such as those related to hearing or mobility impairments, should contact the Department and advise of specific needs.
Review by Administrative Rules Review Committee
The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
The following rulemaking action is proposed:
ITEM 1. Amend rule 441—62.1(425), introductory paragraph, as follows:
441—62.1(425) Eligible claimants. This rule is effective for rent reimbursement claims received by the department on or after January 1, 2023.
ITEM 2. Amend subrule 62.2(3) as follows:
62.2(3) The claims are to be based on the actual property tax due and rent constituting property tax paid, with a combined maximum of $1,000 $1,500 upon which the credit and reimbursement can be calculated.
EXAMPLE: $800 property tax due$400 $900 rent constituting property taxes paid
a. No change.
b. The claim form for calculating the rent reimbursement must reflect only the remaining $200 $700 of the $1,000 $1,500 maximum allowance.
c. No change.
ITEM 3. Rescind rule 441—62.16(425) and adopt the following new rule in lieu thereof:
441—62.16(425) Time for filing a claim.
62.16(1) Claims received after 4:30 p.m. central time Monday through Friday or on a paid holiday, including any paid vacation days granted to state employees by the governor of the state of Iowa, will be considered to be received by the department on the next business day. For the purposes of this rule, “paid holiday” means the same as described in Iowa Code section 1C.2(1).
62.16(2) The granting of an extension of time for filing a claim for reimbursement does not extend the time within which or the dates on or by which eligibility requirements must be satisfied.
This rule is intended to implement Iowa Code section 425.20.
