Notice of Intended Action

Twenty-five interested persons, a governmental subdivision, an agency or association of 25 or more persons may demand an oral presentation hereon as provided in Iowa Code section 17A.4(1)"b."

Notice is also given to the public that the Administrative Rules Review Committee may, on its own motion or on written request by any individual or group, review this proposed action under section 17A.8(6) at a regular or special meeting where the public or interested persons may be heard.

Pursuant to the authority of Iowa Code sections 47.8, 48A.11 and 17A.4, the Voter Registration Commission hereby gives Notice of Intended Action to amend Chapter 2, "Voter Registration Forms, Acceptability, Registration Dates, and Effective Dates," Iowa Administrative Code.

This amendment is necessary because the Commission has updated the voter registration application form. The Commission determined that the voter registration application form approved by the Commission and effective April 9, 2014, needed to be updated in regard to the "gender" portion of the form. To reflect Iowa Code section 48A.11(1)"g," which specifies that the form ask for a potential voter's "sex" instead of "gender," the Commission adopted a change to the form that no longer asks for the voter's "gender" and will now mirror the statute's requirements to ask for the voter's "sex." The Commission adopted the change on April 5, 2016.

Any interested person may make written suggestions or comments on the proposed amendment on or before June 14, 2016. Requests for a public hearing must be received by June 14, 2016.

After analysis and review of this rule making, no impact on jobs has been found.

This amendment is intended to implement Iowa Code section 48A.11.

The following amendment is proposed.

Amend rule 821—2.16(47,48A) as follows:

821—2.16(47,48A) Form of official Iowa voter registration application. The official Iowa voter registration application pursuant to Iowa Code section 48A.11 shall be the State of Iowa Official Voter Registration Form Revised 4/9/2014 4/5/2016.
