Notice of Intended Action
Proposing rule making related to medical conditions for which medical cannabidiol may be used and providing an opportunity for public comment
The Board of Medicine hereby proposes to amend Chapter 13, "Standards of Practice and Principles of Medical Ethics," Iowa Administrative Code.
Legal Authority for Rule Making
This rule making is proposed under the authority provided in Iowa Code section 124E.5.
State or Federal Law Implemented
This rule making implements, in whole or in part, Iowa Code section 124E.5.
Purpose and Summary
On February 7, 2020, the Iowa Board of Medicine convened in open session to consider a petition submitted to the Board by the Iowa Medical Cannabidiol Board pursuant to Iowa Code section 124E.5 requesting the addition of the following condition to the definition of "Debilitating medical condition": "Intellectual disability (ID) with aggression and/or self-injury." The Board voted 4 to 3 to approve and notice the addition of this condition as submitted in the petition. This proposed rule making implements the Board's vote.
Fiscal Impact
This rule making has no fiscal impact to the State of Iowa.
Jobs Impact
After analysis and review of this rule making, no impact on jobs has been found.
Waivers
Any person who believes that the application of the discretionary provisions of this rule making would result in hardship or injustice to that person may petition the Board for a waiver of the discretionary provisions, if any, pursuant to 653—Chapter 3.

Public Hearing
No public hearing is scheduled at this time. As provided in Iowa Code section 17A.4(1)"b," an oral presentation regarding this rule making may be demanded by 25 interested persons, a governmental subdivision, the Administrative Rules Review Committee, an agency, or an association having 25 or more members.
Review by Administrative Rules Review Committee
The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rule making by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rule making at its regular monthly meeting or at a special meeting. The Committee's meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
The following rule-making action is proposed:
Amend subrule 13.15(1), definition of "Debilitating medical condition," as follows:
"Debilitating medical condition" means any of the following:
1.Cancer, if the underlying condition or treatment produces one or more of the following:
●Severe or chronic pain.
●Nausea or severe vomiting.
●Cachexia or severe wasting.
2.Multiple sclerosis with severe and persistent muscle spasms.
3.Seizures, including those characteristic of epilepsy.
4.AIDS or HIV as defined in Iowa Code section 141A.1.
5.Crohn's disease.
6.Amyotrophic lateral sclerosis.
7.Any terminal illness, with a probable life expectancy of under one year, if the illness or its treatment produces one or more of the following:
●Severe or chronic pain.
●Nausea or severe vomiting.
●Cachexia or severe wasting.
8.Parkinson's disease.
9.Untreatable pain.
10.Ulcerative colitis.
11.Severe, intractable pediatric autism with self-injurious or aggressive behaviors.
12.Corticobasal degeneration.
13.Intellectual disability (ID) with aggression and/or self-injury.
