Rulemaking related to administration
The Director of the Workforce Development Department hereby rescinds Chapter 1, “Administration,” Iowa Administrative Code, and adopts a new chapter with the same title.

This rulemaking is adopted under the authority provided in Iowa Code chapter 17A and chapter 84A as amended by 2023 Iowa Acts, Senate File 514.

This rulemaking implements, in whole or in part, Iowa Code chapter 17A and chapter 84A as amended by 2023 Iowa Acts, Senate File 514.
Purpose and Summary
Chapter 1 is the foundational Iowa Administrative Code chapter for the Department. It provides the mission and the overall general organizational structure for the organization.
As part of the Department’s review of rules under Executive Order 10, the Department identified several instances where the current chapter duplicates statutory language and uses restrictive terms. This text is removed from the chapter.

Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on July 10, 2024, as ARC 8130C. A public hearing was held on the following date(s):

Adoption of Rulemaking
This rulemaking was adopted by the Director of the Department on August 14, 2024.

This rulemaking has no fiscal impact to the State of Iowa.

After analysis and review of this rulemaking, no impact on jobs has been found.
Waivers
Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any.
Review by Administrative Rules Review Committee
The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
Effective Date
This rulemaking will become effective on October 9, 2024.
The following rulemaking action is adopted:
ITEM 1.Rescind 871—Chapter 1 and adopt the following new chapter in lieu thereof:
CHAPTER 1
ADMINISTRATION
871—1.1(84A) Mission and overall organization.
1.1(1) Mission. We power Iowa’s possibilities by connecting workers to opportunities and employers to workforce solutions.
1.1(2) Vision. To create, enable and sustain the most future ready workforce in the nation.
1.1(3) Overall organization. The chief executive officer of the department is the director of the department of workforce development who shall be appointed by the governor with the approval of two-thirds of the members of the senate and is responsible directly to the governor.
This rule is intended to implement Iowa Code chapter 84A.
