Rulemaking related to new Iowan centers
The Director of the Workforce Development Department hereby rescinds Chapter 14, “New Iowan Centers,” Iowa Administrative Code.

This rulemaking is adopted under the authority provided in Iowa Code chapter 17A and chapter 84A as amended by 2023 Iowa Acts, Senate File 514.

This rulemaking implements, in whole or in part, Iowa Code chapter 17A and chapter 84A as amended by 2023 Iowa Acts, Senate File 514.
Purpose and Summary
Chapter 14 was originally created to provide administrative rules for New Iowan Centers. However, this program no longer exists. This rulemaking removes Chapter 14 from the Department’s rules.
In addition, as part of the Department’s review of rules under Executive Order 10, the Department identified several instances where the current chapter duplicates statutory language and uses restrictive terms. Rescinding this chapter removes the duplicative and restrictive language.

Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on July 10, 2024, as ARC 8132C. A public hearing was held on the following date(s):

Adoption of Rulemaking
This rulemaking was adopted by the Director of the Department on August 14, 2024.

This rulemaking has no fiscal impact to the State of Iowa.

After analysis and review of this rulemaking, no impact on jobs has been found.
Waivers
Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any.
Review by Administrative Rules Review Committee
The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
Effective Date
This rulemaking will become effective on October 9, 2024.
