Rulemaking related to renewable energy percentage verification
The Utilities Commission hereby rescinds Chapter 30, “Renewable Energy Percentage Verification,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is adopted under the authority provided in Iowa Code section 476.2.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, Iowa Code section 476.44A.
Purpose and Summary
The purpose of this rulemaking is to comply with Executive Order 10. Chapter 30 originally contained the Commission’s rules that established the renewable energy percentage verification procedure. The Commission is rescinding the chapter because the procedure contained in the chapter was voluntary and because the information obtained by the Commission under that procedure can be received through other means.
The Commission issued an order on October 17, 2024, approving the rescission of Chapter 30. The order is available on the Commission’s electronic filing system, efs.iowa.gov, under RMU-2023-0030.
Public Comment and Changes to Rulemaking
Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on July 24, 2024, as ARC 8136C. A public hearing was held on the following date(s):

The Office of Consumer Advocate (OCA), a division of the Iowa Department of Justice; MidAmerican Energy Company (MidAmerican); the Environmental Law and Policy Center (ELPC); the Iowa Environmental Council (IEC); Interstate Power and Light Company; and members of the public attended one or both public hearings.
During the written comment period, the Commission received written comments from OCA, MidAmerican, the ELPC, and the IEC. After the expiration of the comment period, the Commission issued an order that permitted the filing of additional written comments, and additional comments were filed with the Commission by OCA, MidAmerican, the ELPC, and the IEC.
No changes from the Notice have been made.
Adoption of Rulemaking
This rulemaking was adopted by the Commission on October 17, 2024.
Fiscal Impact
This rulemaking has no fiscal impact to the State of Iowa.
Jobs Impact
After analysis and review of this rulemaking, no impact on jobs has been found.
Waivers
No waiver provision is included in the amendments because the Commission has a general waiver provision in rule 199—1.3(17A,474,476) that provides procedures for requesting a waiver of the rules in Chapter 30.

The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
Effective Date
This rulemaking will become effective on January 1, 2025.
