Notice of Intended Action

Proposing rulemaking related to board of directors meeting frequency
and providing an opportunity for public comment

The Credit Union Division hereby proposes to amend Chapter 2, “Organization, Chartering and Field of Membership of a Credit Union,” Iowa Administrative Code.

Legal Authority for Rulemaking

This rulemaking is proposed under the authority provided in Iowa Code section 533.104.

State or Federal Law Implemented

This rulemaking implements, in whole or in part, 2024 Iowa Acts, House File 131.

Purpose and Summary

This proposed rulemaking updates subrule 2.9(1) in accordance with changes to Iowa Code section 533.206, which call for the modification of the meeting requirement for a credit union board of directors.

Review by Administrative Rules Review Committee

The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).

The following rulemaking action is proposed:

ITEM 1.Amend subrule 2.9(1) as follows:

2.9(1) The board of directors shall hold at least 12six regular meetings each calendar yearunless required to hold additional meetings. No more than one regular meeting shall be held in one calendar month.
