Notice of Intended Action
Proposing rulemaking related to concessions and providing an opportunity for public comment
The Natural Resources Department (Department) hereby proposes to rescind Chapter 14, “Concessions,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is proposed under the authority provided in Iowa Code section 17A.7.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, Iowa Code sections 17A.7 and 461A.4(2) and Executive Order 10.
Purpose and Summary
Chapter 14 creates a framework for the Department to competitively hire a business to operate on public lands or waters under the Department’s jurisdiction. However, all concession operations are in state parks, which have their own administrative rules under the Natural Resource Commission[571]. This chapter has not been used in several decades and has not been amended since 1988. Therefore, consistent with Executive Order 10, it can be rescinded.

Waivers
This rulemaking is subject to the waiver provisions of 561—Chapter 10. Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any.
