Notice of Intended Action

Proposing rulemaking related to rescission of chapters
and providing an opportunity for public comment

The Department of Health and Human Services hereby proposes to rescind Chapter 3, “Commission on Aging,” and Chapter 23, “Aging and Disability Resource Center,” Iowa Administrative Code.

Legal Authority for Rulemaking

This rulemaking is proposed under the authority provided in 2024 Iowa Acts, House File 2673.

State or Federal Law Implemented

This rulemaking implements, in whole or in part, 2024 Iowa Acts, House File 2673.

Purpose and Summary

This proposed rulemaking rescinds Chapter 3. The Commission on Aging was eliminated by 2024 Iowa Acts, House File 2673. The proposed rulemaking also rescinds Chapter 23 since the makeup and functions of Aging and Disability Resource Centers were modified by section 153 of 2024 Iowa Acts, House File 2673. To coincide with the rescission of Chapter 23, an Aging and Disability Resource Centers chapter will be repromulgated as 441—Chapter 224 in a separate proposed rulemaking.

Waivers

Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 441—Chapter 6.

The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).

Aging, Department on

The Department on Aging works closely with Iowa's six Area Agencies on Aging and other partners to design a system of information, education, support and services for Iowans that assists them in maintaining their independence.
