The Department of Inspections, Appeals, and Licensing hereby rescinds Chapter 21, “Licensure,” Chapter 22, “Infection Control for Barbershops and Barber Schools,” Chapter 23, “Barber Schools,” Chapter 24, “Continuing Education for Barbers,” and Chapter 25, “Discipline for Barbers, Barber Instructors, Barbershops and Barber Schools,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is adopted under the authority provided in Iowa Code chapters 17A, 147 and 272C and 2023 Iowa Acts, House File 652.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, Iowa Code chapters 17A, 147 and 272C and 2023 Iowa Acts, House File 652.
Purpose and Summary
This rulemaking completes the merger process as directed by 2023 Iowa Acts, House File 652, which repealed Iowa Code chapter 158, created the Board of Barbering and Cosmetology Arts and Sciences (Board) by merging the Board of Barbering and the Board of Cosmetology Arts and Sciences, and preserved the legacy Board of Barbering rules until such time as the rules expire on their own or are otherwise repealed by the Board. Since the merger, the Board has merged and promulgated comprehensive administrative rules governing the barbering and cosmetology arts and sciences, which became effective July 1, 2024. The Board now intends to rescind all legacy rules of the Board of Barbering.

Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on March 19, 2025, as ARC 9007C. A public hearing was held on the following date(s):

Adoption of Rulemaking
This rulemaking was adopted by the Board on May 19, 2025.
Fiscal Impact
This rulemaking has no fiscal impact to the State of Iowa. Staff salaries to support the work of the boards are covered by the Licensing and Regulation Fund established in 2023 Iowa Acts, Senate File 557. Licensing fees go to the fund to cover operations of the regulated professional licensing boards.
Jobs Impact
After analysis and review of this rulemaking, no impact on jobs has been found.
Waivers
Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 481—Chapter 6.

The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
Effective Date
This rulemaking will become effective on July 16, 2025.
