Amended Notice of Intended Action
Providing for a public hearing on rulemaking
related to mechanics’ notice and lien registry
The Notice of Intended Action published in the Iowa Administrative Bulletin on May 28, 2025, as ARC 9290C proposes to amend Chapter 45, “Mechanics’ Notice and Lien Registry,” Iowa Administrative Code. In order to receive oral comments concerning ARC 9290C, the Secretary of State hereby gives notice that a public hearing will be held as follows:

Persons who wish to make oral comments at the public hearing may be asked to state their names for the record and to confine their remarks to the subject of this proposed rulemaking.
Any persons who intend to attend the public hearing and have special requirements, such as those related to hearing or mobility impairments, should contact the Secretary of State and advise of specific needs.

This rulemaking is proposed under the authority provided in Iowa Code section 572.34.

This rulemaking implements, in whole or in part, Iowa Code chapter 572.
Purpose and Summary
The proposed subrules under rules 721—45.4(572) and 721—45.5(572) adopt specifics for renewing, making inactive, and removing inactive Mechanics’ Notice and Lien Registry (MNLR) preliminary notices and notices of commencement of work as required by Iowa Code section 572.34(12). This Amended Notice provides notice of a public hearing pursuant to a request under Iowa Code section 17A.4(1)“b.”

The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
