Rulemaking related to rescission of chapters
The Department of Natural Resources (Department) hereby rescinds Chapter 1, “Description of Organization,” and Chapter 3, “Submission of Information and Complaints—Investigations,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is adopted under the authority provided in Iowa Code chapter 455A and sections 17A.3(1)“b” (rescinded), 17A.7(1) and 17A.9(2).
State or Federal Law Implemented
This rulemaking implements, in whole or in part, 2023 Iowa Acts, Senate File 2370, and Executive Order 10.
Purpose and Summary
The Iowa Administrative Procedure Act has long required agencies to adopt rules describing its internal organization and mission and how to submit information and complaints. To satisfy these obligations, the Department promulgated prior Chapters 1 and 3.
However, 2024 Iowa Acts, Senate File 2370, rescinded this underlying law (section 4). Accordingly, the Department rescinds these chapters consistent with the principles of Executive Order 10 as being either unauthorized or unnecessary. Information about the Department’s structure and important contact information that was previously provided in Chapters 1 and 3 is now available on the Department’s website and in other Department publications. Additionally, specific information regarding filing complaints related to environmental matters was adopted into 567—Chapter 10 during the Department’s 2023 Executive Order 10 rulemaking process.
Public Comment and Changes to Rulemaking
Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on January 8, 2025, as ARC 8642C. A public hearing was held on the following date(s):

Adoption of Rulemaking
This rulemaking was adopted by the Department on June 30, 2025.

This rulemaking has no fiscal impact to the State of Iowa.

Waivers
Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 561—Chapter 10

The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
Effective Date
This rulemaking will become effective on August 27, 2025.
