Rulemaking related to rescission of chapters

    The Iowa Commission on Volunteer Service hereby rescinds Chapter 8, “Iowa Youth Mentoring Program Certification,” Chapter 9, “Iowa Summer Youth Corps,” Chapter 10, “Iowa Green Corps,” Chapter 11, “Iowa Reading Corps,” and Chapter 12, “RefugeeRISE AmeriCorps,” Iowa Administrative Code.

Legal Authority for Rulemaking

    This rulemaking is adopted under the authority provided in Iowa Code chapter 15H.

State or Federal Law Implemented

    This rulemaking implements, in whole or in part, Executive Order 10.

Purpose and Summary

     This rulemaking is the result of the Red Tape Review process outlined in Executive Order 10. As a result of the review, the Commission determined that the content of Chapter 8, for which there was no explicit rulemaking authority, was better suited for policy due to its procedural nature. In addition, the content of Chapters 9 through 12 was combined with 817—Chapter 14 to create a unified chapter on all Iowa National Service Corps projects. That rulemaking was submitted simultaneously (ARC 0474D, IAB 7/22/26).

Public Comment and Changes to Rulemaking

    Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on June 10, 2026, as ARC 0352D. Public hearings were held on the following date:

     ?   June 30, 2026

    No one attended the public hearings. No public comments were received. No changes from the Notice have been made.

Adoption of Rulemaking

    This rulemaking was adopted by the Department of Health and Human Services on July 15, 2026.

Fiscal Impact

     This rulemaking has no fiscal impact to the State of Iowa.

Jobs Impact

    After analysis and review of this rulemaking, no impact on jobs has been found.

Waivers

    Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 7—Chapter 2504.

Review by Administrative Rules Review Committee

    The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).

Effective Date

    This rulemaking will become effective on October 1, 2026.

    ITEM 3.  Rescind and reserve 817—Chapter 10.
