Notice of Intended Action
Proposing rulemaking related to functions of division and juvenile justice youth development program and providing an opportunity for public comment
The Department of Health and Human Services hereby proposes to rescind Chapter 30, “Functions of Division,” and Chapter 31, “Juvenile Justice Youth Development Program,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is proposed under the authority provided in Iowa Code chapter 216A.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, 2023 Iowa Acts, Senate File 514, and Executive Order 10.
Purpose and Summary
As part of the Executive Order 10 Red Tape Review process and pursuant to 2023 Iowa Acts, Senate File 514, regarding government realignment, the Department has moved relevant chapters from the legacy Department of Human Rights agency [421] to agency [441].
The Department consulted with the Department of Public Safety on Chapter 30 and it was determined that the information in this chapter is no longer needed. As such, the Department is proposing to rescind this chapter and will not repromulgate it under agency [441].
Chapter 31 addresses the grant process for funds received through Title II of the federal Juvenile Justice and Delinquency Prevention Act. Because the information in the chapter can be covered in the grant contracts themselves, this chapter is proposed to be rescinded and will not be repromulgated under agency [441].

Waivers
Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Department for a waiver of the discretionary provisions, if any, pursuant to 441—Chapter 2504.
