Notice of Intended Action
Proposing rulemaking related to motor fuel and antifreeze tests and standards
and providing an opportunity for public comment
The Agriculture and Land Stewardship Department hereby proposes to amend Chapter 85, “Weights and Measures,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is proposed under the authority provided in Iowa Code section 214A.1A.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, Iowa Code section 214A.2.
Purpose and Summary
The proposed rulemaking incorporates recent updates made with the American Society for Testing and Materials (ASTM) International fuel specifications as of July 9, 2024. These updates will provide uniformity for fuel manufacturers and suppliers across the region and nationwide.
Additionally, the proposed rulemaking provides a narrow exception from ASTM International specifications during the month of March. This exception keeps Iowa at the same volatility class in the month of March that has been in place since 1988 and aligns Iowa fuel specifications with neighboring states. This will help to ensure that Iowa does not experience fuel availability issues or cost increases that would be experienced by consumers.

Waivers

Public Hearing
No public hearing is scheduled at this time. As provided in Iowa Code section 17A.4(1)“b,” an oral presentation regarding this rulemaking may be demanded by 25 interested persons, a governmental subdivision, the Administrative Rules Review Committee, an agency, or an association having 25 or more members.
Review by Administrative Rules Review Committee
The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).
The following rulemaking action is proposed:
ITEM 1.Amend subrule 85.20(1) as follows:
85.20(1) In the interest of uniformity, the tests and standards for motor fuel, including but not limited to renewable fuels such as ethanol blended gasoline, biodiesel, and biodiesel blended fuel, and components such as an oxygenate, raffinate natural gasoline and motor vehicle antifreeze shall be those established by ASTM International in effect on June 30, 2023July 9, 2024, with the following exceptions:
a.Biodiesel blended fuel classified as higher than B-20 but less than B-99.
b. For the month of March, the volatility class shall be E-5/D-4 for ethanol blended gasoline.
b. c.Tests and standards that are otherwise required by statute.
