Notice of Intended Action
Proposing rulemaking related to investigations and disciplinary procedures
and providing an opportunity for public comment
The Real Estate Commission hereby proposes to amend Chapter 18, “Investigations and Disciplinary Procedures,” Iowa Administrative Code.
Legal Authority for Rulemaking
This rulemaking is proposed under the authority provided in Iowa Code section 543B.18.
State or Federal Law Implemented
This rulemaking implements, in whole or in part, Iowa Code chapters 543B and 17A.
Purpose and Summary
The proposed amendment implements Iowa Code section 543B.56A, which imposes a civil penalty for failure to have a brokerage agreement.

The following rulemaking action is proposed:
ITEM 1.Amend subrule 18.14(5) as follows:
18.14(5) Violations for which civil penalties may be imposed. The following is a nonexclusive list of violations upon which civil penalties may be imposed:

s. Failing to have a brokerage agreement signed as outlined in Iowa Code section 543B.56A.
s. t.Violating any of the remaining provisions in 193E—Chapters 1 through inclusive2022that have not heretofore been specified in this rule.
