Rulemaking related to Iowa teacher shortage loan forgiveness program

The College Student Aid Commission hereby rescinds Chapter 35, “Iowa Teacher Shortage Loan Forgiveness Program,” Iowa Administrative Code.

Legal Authority for Rulemaking

This rulemaking is adopted under the authority provided in Iowa Code section 256.178.

State or Federal Law Implemented

This rulemaking implements, in whole or in part, Iowa Code section 256.220.

Purpose and Summary

This rulemaking rescinds Chapter 35 for the Iowa Teacher Shortage Loan Forgiveness Program. 2017 Iowa Acts, House File 642, section 2, prohibited the making of new awards under the Iowa Teacher Shortage Loan Forgiveness Program but allowed a renewal applicant to continue to be considered for awards until the applicant’s eligibility is exhausted. The last renewal applicants received awards in FY 2020, and the program has not received an appropriation since FY 2019. The legislative directive has been administratively achieved, the program has been phased out, and there is no further benefit of the chapter. The existing chapter is rescinded under Executive Order 10 to ensure that outdated and obsolete provisions are eliminated.

Notice of Intended Action for this rulemaking was published in the Iowa Administrative Bulletin on November 27, 2024, as ARC 8400C. A public hearing was held on the following date(s):

This rulemaking was adopted by the Commission on January 10, 2025.

Fiscal Impact

This rulemaking has no fiscal impact to the State of Iowa.

After analysis and review of this rulemaking, no impact on jobs has been found.

Waivers

Any person who believes that the application of the discretionary provisions of this rulemaking would result in hardship or injustice to that person may petition the Commission for a waiver of the discretionary provisions, if any, pursuant to 283—Chapter 7.

The Administrative Rules Review Committee, a bipartisan legislative committee which oversees rulemaking by executive branch agencies, may, on its own motion or on written request by any individual or group, review this rulemaking at its regular monthly meeting or at a special meeting. The Committee’s meetings are open to the public, and interested persons may be heard as provided in Iowa Code section 17A.8(6).

Effective Date

This rulemaking will become effective on March 26, 2025.
